These terms apply when you access betterpowered.com or use a BetterPowered online assessment, preliminary property plan, contractor-matching workflow, or related service. By using the service, you agree to these terms. If you use the service for a business or another property owner, you represent that you have authority to do so.
Preliminary planning service
BetterPowered organizes property information and provides preliminary planning guidance. A plan may identify priorities, dependencies, assumptions, possible upgrades, evidence to collect, potential incentives, and next actions. It is not a final engineering design, code analysis, permit, equipment selection, contractor proposal, tax opinion, legal opinion, insurance determination, or guarantee.
You are responsible for providing accurate information and for reviewing material assumptions before acting. Site conditions, records, measurements, utility rates, occupant behavior, product selection, design, and installation can change an outcome.
On-site services
The BetterPowered Whole-Home Energy Assessment is separate from the free online plan, and BetterPowered is its provider where coverage is available. Scope, price, limitations and terms are disclosed before scheduling. Specialist tests or diagnosis outside that scope may be provided by an appropriately qualified third party, and a field visit does not replace work reserved to a licensed professional or authority.
Contractors and project agreements
You may use your own contractor or request a match with a participating contractor where coverage is available. Unless expressly stated in a separate written agreement, BetterPowered is not the installer and is not a party to the contract between you and a contractor.
The contractor is responsible for its proposal, licensing, insurance, permits, design, products, labor, schedule, site safety, warranties, financing offers, and compliance with applicable law. You are responsible for reviewing and accepting the contractor's agreement. See the contractor relationship disclosure.
Estimates, savings, resilience, and net-zero examples
Energy, cost, production, offset, comfort, resilience, and outage estimates are based on assumptions and available information. Actual performance is not guaranteed. An annual solar offset estimate does not mean off-grid operation, uninterrupted backup power, or a certification. Illustrative scenarios are not customer results.
Financing, rebates, and tax information
Financing may be offered by a contractor or independent provider and is subject to that provider's terms, underwriting, rates, fees, and approval. Incentive and tax information can change and does not guarantee eligibility, funding, approval, or tax treatment. Review the financing and incentive terms and confirm current rules with the responsible provider or authority before committing to work.
Acceptable use
You may not misuse the site or service; interfere with its operation or security; attempt unauthorized access; submit unlawful, harmful, deceptive, or infringing content; impersonate another person; scrape or automate access in a way that burdens the service; or use the service to violate law or another person's rights.
Intellectual property
The BetterPowered name, site design, original graphics, software, and service content are protected by applicable intellectual-property laws. You may download or use a property plan provided to you for evaluating and completing work at the applicable property. This limited use does not transfer ownership of the BetterPowered platform, templates, or brand assets.
Third-party services and links
The service may link to contractors, utilities, program portals, financing providers, government agencies, and other third parties. BetterPowered does not control their content, availability, terms, or actions. Your use of a third-party service is governed by its agreement with you.
Service availability and changes
We may change, suspend, limit, or discontinue parts of the service, including a trade or geographic coverage, as the platform and contractor network develop. We may also update these terms. The review date identifies the current published version.
Disclaimers and limitation of liability
To the extent permitted by law, the site and preliminary planning service are provided “as is” and “as available.” BetterPowered disclaims warranties that are not expressly stated in a separate written agreement. To the extent permitted by law, BetterPowered will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the public site or reliance on preliminary information.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. Nothing in these terms limits rights or liability that cannot legally be limited.
Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
